Captis Product Warranty

1. Warranty Against Defects

In addition to your Statutory Rights under the Australian Consumer Law set out below, mIoT warrants that your Captis™ hardware will be warranted for a period of:

  • For battery only powered devices, five (5) years or 5,000 transmissions (whichever occurs first) from date of invoice.
  • For Captis Solar and Captis Power+ devices, five (5) years from date of invoice.

This includes manufacturing defects and internal component failure including but not limited to printed circuit assembly, electronic components, internal antenna and battery.

1.1 The warranty is subject to the following conditions being met:

a) The device is operated within the specifications as per the product datasheet [all Captis™ devices]
b) The device is installed by a Captis™ certified installer following the official Captis Installation Guides. To register for training and certification please visit miot.com.au/resources/captis-installation-course/
c) The signal strength is better than -96dB for 80% or more of the transmissions (Reference Signal Received Power) and the data payload not exceeding 50KB per transmission [Captis™ Solar and Captis™ Power+ exempted]
d) The minimum solar radiation of 6 Megajoules/m2 per day [Captis™ Solar only]

1.2 Factors affecting the battery life include:

a) User device configuration;
b) More frequent data transfer connections on the cellular network;
c) Multiple sensors connected resulting in larger data payloads;
d) Incorrect installation of products, external antenna or sensors;
e) Non-manufacturer approved sensors connected to the products;
f) Incorrectly installed sensors;
g) Incorrect storage of supplied products;
h) Weak cellular network signal strength

1.3 Exclusions

The warranty will be void if:

a) Products have been tampered with or modified in any way;
b) Products and/or externally connected accessories such as sensors, instruments and external antennas have been incorrectly installed;
c) Products have been connected to external products not approved by mIoT

2. Making a Claim

In the event your Captis™ device stops working, or if you encounter any problem with it, or need assistance with making a claim under Clause 1, please contact your distributor (distributor contact details will appear on the sales documentation).  If the distributor is unable to help you and your Captis™ device is still not working, the distributor will assist you in making a claim under this Warranty Against Defects. Where a valid claim is made under Clause 1, mIoT will, at no cost to you, try to repair or replace your Captis™ device within a reasonable time. If we are unable to repair or replace, mIoT may choose to offer you a refund instead.

All Captis™ devices automatically log operating environment and performance data.  This data may be extracted and analysed by mIoT to determine the validity of a warranty claim.

3. Statutory Repair Notice

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods. Repair of the goods may result in the loss of user generated data.

Subject to your Statutory Rights, if your claim under Clause 1 is not valid, you may be charged a fee under this Warranty Against Defects for the service of repairing or replacing your device and for any direct costs associated with having your Captis™ device delivered for service. This will be at your option, and we will contact you to confirm the fee before we proceed with the service.

The benefits conferred by this Warranty Against Defects are in addition to other rights and remedies that are available to you under law including your Statutory Rights, which cannot be excluded. The processes for this Warranty Against Defects in no way limits your rights, which arise as a result of your Statutory Rights.

This Warranty Against Defects is given by mIoT Pty Ltd ABN 61 619 635 924 – 1/61 Metroplex Avenue, Murarrie QLD 4172.

Please do not attempt to return your product to the address above.

This Warranty does not apply:
a) to consumable parts, (such as protective coatings that are designed to diminish over time), or cosmetic damage, (including but not limited to scratches, dents, and broken plastic on ports), unless failure has occurred due to a defect in materials or workmanship;
b)  to damage caused by:
i) accident, abuse, misuse, fire, liquid contact, impact or other external cause; or
ii) operating the Captis™ device outside mIoT’s published guidelines;
c) to a Captis™ device that has been:
i) modified to alter functionality or capability without the written permission of mIoT; or
ii) otherwise modified or open; and
d) to defects caused by normal wear and tear or otherwise due to the normal aging of the Captis™ device.

4. Limitation of Liability

mIoT’s sole obligation and liability under this warranty is to comply with the provisions of this Warranty Against Defects document. To the extent permitted by law, we exclude all other liability whether to you or a third party for breach of contract, negligence or breach of any other law.  For any liability which cannot lawfully be excluded, our liability is limited to resupplying or paying the cost of resupplying services and repairing, replacing or paying the cost of repairing or replacing goods.

5. Statutory Rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

a) to cancel your service with us; and
b) to a refund for the unused portion, or to compensation for its reduced value.

You are entitled to choose a replacement or refund for a major failure with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

6. Captis™ Use

Captis™ products are intended for use in approved regions, on approved carrier networks. For use while travelling on a plane, mIoT recommend you consult with the airline’s specific policies regarding battery-powered devices to avoid any complications. Captis™ products are NOT intended for use in critical applications in which failure of the Captis™ device could result directly or indirectly in death, personal injury, or severe property or environmental damage.

7. Safety Precautions – Use and Handling

Before using a Captis™ device, please read the installation guide to learn how to set-up, use and handle your Captis™ device and any accessories. Captis™ devices have been designed to operate safely under normal conditions. However, if used improperly, any electrical device has the potential to cause fire, electrical shock or personal injury. To help ensure accident-free operation of your Captis™ devices, please follow these guidelines:

a) Observe all warnings, precautions and instructions;
b) Regularly inspect the device or mounting accessories for damage;
c) Do not dismantle the Captis™device if it functions in an abnormal manner, produces unusual sounds, smells or becomes too hot to touch. Please contact the Captis™ Support Team for assistance; and
d) Only connect the device to mIoT approved accessories or sensors.

In addition, and for your safety, make sure you comply with the following instructions:

e) Do not touch your Captis™ devices or connected cables during an electrical storm;
f) Do not allow small particles or other foreign objects to get into your Captis™ devices or accessories;
g) Do not expose your Captis™ devices to smoke or steam;
h) Do not expose your Captis™ devices or accessories to low or high temperatures, high humidity or direct sunlight (unless they are rated and labelled for this type of use);
i) Do not place your Captis™ devices in a place where they may cause someone to trip or stumble; do not attempt to open your Captis™ device;
j) Treat the device with reasonable care; and
k) If the device shows signs of damage stop using immediately.

If your Captis™ device gets warm/hot during use, please discontinue use and contact the Captis™ Support Team at 1800 646 828.

We do not warrant that your Captis™ device will be free from defects caused by an accident, natural causes, misuse, abuse, improper installation or operation, vermin infestations, lack of reasonable care, unauthorised modification, loss of parts, tampering or attempted repair by a person not authorised by mIoT; or where the Captis™ device has been damaged by lightning. Except as stated in this Warranty Against Defects document, the Captis™ device is provided “as is”, and all other representations, warranties, terms or conditions, oral or written, express or implied, arising from course of dealing, course of performance, usage of trade, quality of information, quiet enjoyment or otherwise (including implied warranties, terms or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, non-interference, or non-infringement) are, to the fullest extent permitted by applicable law, excluded from this agreement.
